Michael and Adam will discuss the damages issues arising out of the recent Court of Appeal decision in Wellesley Partners v Withers, which explored questions of the appropriate test for remoteness in concurrent (contract/tort of negligence) liability cases, and the proper approach to proof and loss of chance in lost profit claims.

Brie and John will use a case study to take you through the options for an original proprietor and the innocent purchaser or lender faced with a fraudulent transaction. They take you to the recent decisions and will look at the solutions that can be pursued against Land Registry and the parties’ solicitors.
